By using our Website and Products and Services, you agree to be bound by these terms and conditions.

Liability and Professional Indemnity

EosBody Practitioners are fully insured to provide the services offered under the terms and conditions specified here.

Any information or services available throughout or in connection with the website, or at any treatment given by EosBody, do not constitute medical advice and it is your responsibility to determine, through obtaining appropriate medical advice, that you are fit and well for such treatment.

You will endeavour to the best of your knowledge to provide us with any health or background information that may be relevant to provision of our Products, Services and Treatments to you. You should update us immediately regarding any change in your circumstances which may affect your engagement with our Products, Services and Treatments. We cannot be held liable for any incorrect information supplied to us.

We will endeavour to ensure that information we provide to you is correct to the best of our knowledge, including information supplied in the Website and any information we supply with relation to provision of the Products, Services or Treatments. We do not accept liability for any error or omission which may pertain within the information or arise in future due to technical or other advancements.. We exclude all liability for any action you take, loss or injury you may suffer (direct or indirect including loss of pay, profit, opportunity or time, pain and suffering, any indirect, consequential or special loss, however arising) as a result of relying on any information on this website or provided through any service supplied by us to you.

You, your legal representatives and your heirs’ release, waive, discharge and covenant, not to sue EosBody and its practitioners for any injury or death caused by their negligence or other acts.

EosBody warrants that the products and services will be supplied with reasonable skill and care.

On that basis, except as expressly set out in these terms, EosBody does not enter into conditions, warranties or other terms in relation to the website or the products or the services (including any implied term relating to quality, fitness for a particular purpose) or any guaranteed or predicted result.

EosBody has included links to these websites and co-branded pages to provide you with access to information and services that you may find useful or interesting. However, EosBody is not responsible for the content of other websites and pages not managed by EosBody or for anything provided or supplied by them. 

Subject to the important liability statement, EosBody is not liable for failure to comply with these terms and conditions due to any event beyond its reasonable control, including, without limitation, the input of incorrect information by you. 

Statutory Rights, Refunds and Cancellation

The rights of cancellation, refunds and any limitation expressed in these terms and conditions do not affect your statutory rights as a consumer. Refunds in relation to products or services may only be refunded to the credit or debit card originally used to make the purchase.

Suspension and Termination of Service

EosBody may suspend the operation of the website for repair or maintenance work or in order to update or upgrade the contents or functionality of the website from time to time. Access to or use of the website or any websites or pages linked to it will not necessarily be uninterrupted or error-free.

EosBody may terminate the service immediately in the event you breach any of these terms and conditions or do not pay any sums due to EosBody (including if the credit/debit card you use is not valid or does not work for another reason).

Availability

Availability of any Product, Service or Treatment is subject to change and may be dependent on factors including concurrent bookings, long term bookings, preparation of the venue, suppliers and staff as well as other reasonable factors not listed in these terms and conditions. We will endeavour to accommodate you in the most appropriate mode of delivery for your needs. Availability of the Website or any specific Product, Treatment or Service may be subject to change without notice, including for purposes of updates, maintenance, revision of content, addition of new content, training, events and other factors ourside of our control.

Payment of Fees

Information regarding fees and availability of Products, Services, and Treatments and displayed on the Website or other Eosbody communications may be subject to change by EosBody at any time and without notice.

All products, services and treatments must be paid for in accordance with the Prices agreed before your appointment/treatment at the time of confirming your booking. Non payment of fees will result in termination of your agreement and initiation of action to recover any unpaid fees plus reasonable administrative costs.

Delays, Extensions and Cancellations

By confirming your booking you agree to our 24 hour notice of cancellation policy. If you are booked for an appointment and do not provide at least 24 hours notice of change or cancellation you will still be charged the full fee.

If after the commencement of your appointment, you wish to extend the time you have booked, the Practitioner will endeavour to fulfil your request. This subject to the availability of the Practitioner, and payment of an additional charge for the extended time calculated in accordance with the Prices.

If you are delayed and unable to start the Massage at the Designated Premises at the Massage Appointment Time by more than 10 minutes, then, unless the Practitioner agrees to the contrary (which is within the sole discretion of the Practitioner):

• the Practitioner is entitled to end the Massage at the time agreed when the booking was made without making any adjustment to the Massage Fee to reflect the reduced time of the Massage; OR
• if you and the Practitioner should agree to proceed with the Massage for the full time allotted notwithstanding the delayed start time, then the Practitioner shall be entitled to receive and you shall be obliged to pay before the relevant treatment is given or appointment time is extended, an additional charge, calculated at the rate set out with the Massage Prices for extra time.

Your Personal Information

Usage of your personal information is governed by the privacy policy.

Contract Information

No contract will exist in relation to the services or products until EosBody has confirmed to you by email the particulars of your order, the value of your order and the products or services (as applicable) you have purchased.

Prohibited Use

Our Services are for your personal and non-commercial use and must only be used for the purposes of inquiring about or making purchases or bookings for Products, Services and Treatments as expressly described above. You must not use the Site or our Products, Services or Treatments or any mode of communication with us including email, telephone, social media or any other mode or medium of communication to do any of the following which are strictly prohibited:

• Engage in any inappropriate behaviour including but not limited to illicit or sexually suggestive remarks, sexual advances, drug use, excessive drinking and/or other inappropriate behaviour;
• Restrict or inhibit any other user from using and enjoying Our Products , Services and Treatments;
• Infringe the privacy rights, property rights, or other civil rights of any person;
• Harass, abuse, threaten or otherwise infringe or violate the rights of Practitioners, EosBody (including its employees and personnel) or others;
• Harvest, data-mine or otherwise collect information about others, including email addresses, without their consent;
• Use technology or other means to access our computer network, unauthorised content or non-public spaces;
• Introduce or attempt to introduce any viruses or any other harmful code, files or programs that interrupt or otherwise or limit Our Products, Services or Treatments or the Website’s functionality;
• Damage, disable or otherwise impair our servers or networks or attempt to do the same; and
• Engage in or encourage others to engage in criminal or unlawful conduct or breach these Terms including misuse of Our Products, Services or Treatments for unlawful or unauthorised purposes.

You agree not to breach these Terms in any way which may result in, among other things, termination or suspension of your access to Our Products, Services and Treatments.

Intellectual Property

EosBody, the EosBody brand, images, and all other intellectual property rights, trademarks, service marks, graphics and logos used in connection with Our Website and/or the Services (whether registered or unregistered) belong to us or our licensors (as are applicable) and are protected by intellectual property law.
